If your family law case involves domestic violence, the following California Family Law Code Section may apply:

Presumption against persons perpetrating domestic violence.

Family Code Sec. 3044:
(a) Upon finding by a court that a party seeking custody of a child has perpetrated domestic violence against the other party seeking custody of the child or against the child or the child's sibling within the previous five years,

...there is a rebuttable presumption that an award of sole or joint physical or legal custody of a child to

...a person who has perpetrated domestic violence is detrimental to the best interest of the child,

...pursuant to Section 3011. This presumption may only be rebutted by a perponderance of evidence..

Mr. Kelly was Chairman of the California State Bar Custody Committee when the California Domestic Violence Act was proposed, written, and passed.

Mr. Kelly furnished a Los Angeles County District Attorney domestic violence prosecutor, a psychologist, and a women's rights activist regarding domestic violence issues as presenters for the Los Angeles Police Department Domestic Violence Protective Task Force.

For many years, Mr. Kelly has been sought after as a speaker on domestic violence issues. He recently aired on a CBS show regarding domestic violence against pregnant women.

Mr. Kelly has created a domestic violence prosecution and defense team. This special team has been exceptionally successful for our clients in their important domestic violence litigation.

Mr. Kelly was the attorney for the Tanya Tucker vs.Ben Reed custody case. Mr. Kelly was the attorney for numerous high profile celebrity and athlete divorce cases over the last 30 years.
